Terms of service


ChaChaCha Inc. (hereinafter referred to as "ChaChaCha") establishes the following terms and conditions for the use of its official website and associated social media services (hereinafter collectively referred to as "the Service").

 

Section 1: Application and Amendments of Terms

  • These Terms apply to the provision and use of the Service, forming a contract between ChaChaCha and the users (as defined in Article 3).
  • ChaChaCha may amend these Terms without prior consent from users. Continued use of the Service after amendments constitutes acceptance of the changes.

Section 2: Use of the Service

  • Users shall use the Service in accordance with these Terms and the "User Guide" or other rules separately established by ChaChaCha.
  • ChaChaCha may change the content of the Service without prior notice.

Section 3: Users

  • Users" are individuals who browse or use the Service, including making purchases. Using the Service signifies agreement to these Terms.
  • Orders through the Service are limited to individuals for personal use only. Users represent and warrant that products purchased will not be resold, distributed, or used for commercial purposes.
  • When paying by credit card, users must use a card in their own name.
  • For minor users, parental consent may be required as necessary.

Section 4: Notification of Changes

Users shall promptly notify ChaChaCha of any changes to their registered information such as address, name, or phone number by the method specified by ChaChaCha.

Section 5: Suspension of Service Provision

ChaChaCha may refuse or cancel orders or suspend the Service without prior notice if any of the following apply to the user:
  1. Delay or failure in payment obligations.
  2. Violation of prohibited acts defined in Article 6.
  3. Suspected commercial orders such as resale or distribution.
  4. Other breaches of these Terms.

Section 6: Prohibited Acts

Users shall not engage in the following acts:
  1. Purchasing products for resale, distribution, or commercial purposes.
  2. Unauthorized use of credit cards.
  3. Unauthorized use of another person's email address or password.
  4. Acts causing nuisance, disadvantage, or damage to others or ChaChaCha.
  5. Infringement of trademark, copyright, privacy, or other rights.
  6. Acts violating laws or public order and morals.
  7. Other acts deemed inappropriate by ChaChaCha.

Section 7: Copyright and Intellectual Property Rights

  • Copyrights, trademarks, and other intellectual property rights of images, text, logos, designs, etc., within the Service belong to ChaChaCha or rightful owners. Unauthorized use, reproduction, or redistribution is prohibited.
  • Downloading or copying information from the Service is limited to private use only.
  • Users are responsible for damages caused by violations of this Article.
  • The site's name, logo, and layout are also subject to copyright and trademark protections.

Section 8: Management of ID and Password

  • Users are responsible for managing their ID and password.
  • Transfer, lending, or disclosure to third parties is prohibited.
  • Users bear responsibility for damages from unauthorized use.
  • Users must promptly notify ChaChaCha upon discovering unauthorized use.

Section 9: Privacy Policy

Handling of users’ personal information shall comply with ChaChaCha’s separate Privacy Policy.

Section 10: Purchase of Products

  • Users may purchase products by methods prescribed by ChaChaCha.
  • A sales contract is concluded when the user applies for purchase and ChaChaCha notifies shipment completion. However, ChaChaCha may cancel the contract afterwards.
  • Cancellations after completing an order are not accepted.

Section 11: Contract Termination

ChaChaCha may terminate sales contracts in the following cases:
  1. Violation of these Terms by the user.
  2. Concerns about the user's payment ability.
  3. Product shortage, discontinuation, or supply difficulties.
  4. Delivery impossibility due to unknown address or long-term absence.
  5. Other fraudulent or inappropriate acts.
ChaChaCha shall not be liable for any damages caused by contract termination.

Section 12: Payment

  • Users must pay the full amount including product price, shipping, fees, and taxes by the payment deadline. Non-payment may invalidate the contract.
  • Payment methods may be restricted depending on product or age.
  • Disputes regarding credit card payments or other methods shall be resolved between the user and the payment company; ChaChaCha holds no responsibility.
  • Payments shall be made in Japanese Yen.
  • Fees related to payment (e.g., handling fees) are borne by the user.
  • Users acknowledge that exchange rate fluctuations or currency conversion fees may alter the billed amount.

Section 13: Returns and Exchanges

  • ChaChaCha strives to ensure product quality. In case of damage or incorrect delivery, users must contact ChaChaCha within 7 days of receipt for prompt return or exchange.
  • Returns or exchanges will not be accepted under the following conditions:
(1) More than 7 days after product arrival.
(2) User convenience such as change of mind or wrong order.
(3) Used or opened products.
(4) Damage caused by user handling.
(5) Sale items or special bundles explicitly marked as non-returnable.
  • Shipping costs for returns/exchanges are borne by ChaChaCha if caused by its responsibility; otherwise by the user.

Section 14: Disclaimer

  • ChaChaCha is not responsible for delays or interruptions caused by natural disasters, system failures, delivery delays, stock shortages, or other reasons beyond its control.
  • ChaChaCha does not guarantee the completeness, accuracy, or usefulness of information obtained through the Service.
  • Except in cases of intentional or gross negligence by ChaChaCha, it shall not be liable for damages (including indirect or lost profits) incurred by users in connection with the Service.
  • ChaChaCha is not responsible for allergies or health issues caused by product use. Users should consult professionals if concerned.

Section 15: Suspension or Termination of the Service

ChaChaCha may suspend or terminate part or all of the Service without prior notice if any of the following occur:

(1) System maintenance, inspection, or updates.

(2) Fire, power outage, natural disaster, etc. affecting operation.

(3) Communication line failures.

(4) Other unavoidable reasons judged by ChaChaCha.

ChaChaCha bears no responsibility for damages to users or third parties due to suspension or termination.

Section 16: Governing Law

  • These Terms and any related disputes shall be governed and interpreted by Japanese law.
  • The Shizuoka District Court shall have exclusive jurisdiction as the court of first instance for disputes arising from the use of the Service.

Section 17: International Shipping

  • Ownership and risk of products transfer to the user once shipped from ChaChaCha. Users must check delivery status themselves. Except for defective or incorrect products, order changes or cancellations after shipment are not accepted.
  • Delivery times may vary depending on carriers, customs, weather, disasters, etc. ChaChaCha does not guarantee delivery periods.
  • Customs duties, VAT, handling fees, and other taxes imposed by destination countries are borne by the user and must be paid upon receipt.
  • ChaChaCha is not responsible for damage or loss caused by customs inspections and will not handle returns, exchanges, or refunds related to these issues.
  • For damaged or defective products, users must keep all packaging and contact ChaChaCha within 7 days of arrival for investigation by the carrier.
  • In some countries, delivery may require users to pick up packages at local carriers or customs offices. Users are responsible for these pickups. If no notification is received, users should check tracking numbers and contact local carriers or customs.
  • If products are returned to ChaChaCha, reshipping costs are borne fully by the user. Reshipment will use ChaChaCha-designated services with applicable shipping fees.
  • Even if cancellations are permitted under these Terms, ChaChaCha may cancel orders if the user violates the Terms. Any transaction fees charged by banks, card companies, or payment services, as well as exchange rate fluctuations, are not ChaChaCha’s responsibility.
  • Refunds or returns will not be accepted after 180 days from the order date, even if permitted under these Terms.
